Dispute Resolution and Civil Litigation
We have years of experience working in litigation for both plaintiffs and defendants. Given the costs and time involved in Court proceedings, it is usually best to resolve disputes prior to initiating proceedings.
We can help assess whether you have a valid claim, or whether it is worth defending a claim against you.
Prior to initiating Court proceedings, we will first attempt to resolve your dispute through negotiations, mediations and alternative dispute resolution in order to save on costs and time. If this is unsuccessful, we can initiate Court proceedings if you have a claim with a good prospect of success.
Where you are a plaintiff, it is important that your claim is based on a solid legal and factual position. It is also important that your claim is prepared by experienced counsel to ensure that the elements of your claim are pleaded correctly. If your claim is later found to have been flimsy or that there was little prospect of success, you may be liable to pay a portion of the other party’s costs. Further, if your claim is not pleaded properly and you are later required to amend your claim, you could be liable to pay the other party’s costs to prepare a defence to your earlier claim that was not pleaded correctly.
Where you are the defendant of a claim and you have a valid defence to the claim against you, it is important that your defence is put forward and pleaded correctly in order increase your chance of successfully defending the claim. Having a strong defence may also help in settling the dispute at an earlier stage.
In circumstances where you have no defence or where the plaintiff has a strong claim against you, it may be in your best interests to settle the dispute early rather than spending time and money defending Court proceedings. In these situations, it is important to settle your claim early in the proceedings, as the Court could order you to pay a portion of the plaintiff’s costs if it is found that you could have settled your matter at an earlier stage but refused to do so.
We work closely with experienced counsel who can navigate the best path forward and ensure that your claim or your defence gets off on the right foot.
If you have a potential claim or are a defendant of a claim, please contact us to schedule a consultation so that we can advise you as to your best path forward.
